TERMS OF USE

Terms of Use

Last Updated: September 23, 2026

These Terms of Use (“Terms”) apply when you access or use websites, event pages, speaker application pages, speaker onboarding pages, sponsor onboarding pages, attendee or registration workflows, surveys, private links, upload tools, communication tools, the WorkPossible Learning Center, and other related products and services operated by CultureCon LLC (“WorkPossible,” “we,” “us,” or “our”) (collectively, the “Services”).

By accessing or using the Services, registering for an event or service, enrolling in a Learning Center course, submitting information, uploading files, clicking an acknowledgement, approving materials, signing electronically, or otherwise participating in a WorkPossible workflow, you agree to these Terms. If you do not agree to these Terms, you should not use the Services.

Some events, sponsorships, speaker engagements, media uses, ticket purchases, courses, customer relationships, or partner arrangements may be governed by separate written agreements. If these Terms conflict with a signed speaker agreement, speaker acceptance letter, media release, sponsor agreement, customer agreement, event specific policy, Appearance Release and Copyright License, or other applicable written agreement, the more specific written agreement will control for that subject matter.

PART I: GENERAL TERMS

1. Permitted Use

You may use the Services only for legitimate purposes related to WorkPossible and its events, programs, educational offerings, and business activities. These purposes may include registering for events, submitting speaker applications, completing onboarding tasks, uploading requested materials, reviewing event information, submitting sponsor or exhibitor materials, completing surveys, managing registration related tasks, approving promotional materials, accessing Learning Center content, signing acknowledgements, and communicating with WorkPossible.

You agree not to:

  1. Use the Services for unlawful, fraudulent, deceptive, harassing, harmful, or unauthorized purposes.

  2. Attempt to access records, links, systems, accounts, files, or data you are not authorized to access.

  3. Share private links, access tokens, account credentials, or restricted materials with unauthorized people.

  4. Upload malware, malicious files, infringing content, intentionally misleading content, or content that violates another person’s rights.

  5. Interfere with, disrupt, scrape, overload, reverse engineer, or compromise the Services.

  6. Impersonate another person or misrepresent your affiliation, authority, company, credentials, role, or rights.

  7. Use attendee, sponsor, speaker, author, student, or other information obtained through the Services for unauthorized marketing, resale, scraping, solicitation, or other unrelated purposes.

We may suspend, restrict, revoke, expire, or terminate access when we believe doing so is reasonably necessary for security, legal compliance, event operations, misuse prevention, enforcement of these Terms, or protection of WorkPossible or others.

2. Your Submissions and Responsibilities

You are responsible for the accuracy, completeness, legality, and appropriateness of information, files, links, biographies, profile information, company information, logos, headshots, presentation materials, session descriptions, co presenter information, sponsor materials, billing information, approvals, signatures, course materials, and other content you submit through the Services (“Submitted Content”).

You represent and warrant that:

  1. You have the right and authority to submit the Submitted Content.

  2. You have obtained any permissions necessary to provide information or materials relating to co presenters, employees, contractors, company representatives, sponsors, customers, or other third parties.

  3. Your Submitted Content does not infringe, misappropriate, or violate intellectual property, privacy, publicity, contractual, confidentiality, or other rights.

  4. Your Submitted Content is not knowingly false, misleading, defamatory, obscene, unlawful, malicious, or harmful.

  5. If you submit materials or take actions on behalf of a company or organization, you have authority to do so.

If your information changes or you believe information or materials were submitted incorrectly, please contact WorkPossible promptly.

3. Submitted Content License

You retain ownership of your Submitted Content, subject to any separate agreement, release, license, or written authorization.

By submitting content through the Services, you grant WorkPossible and its authorized event organizers, reviewers, contractors, and service providers a nonexclusive, worldwide, royalty free license to use, host, store, reproduce, process, adapt, edit, display, distribute, publish, transmit, and create derivative works from your Submitted Content as reasonably necessary to:

  1. Review applications and submitted materials.

  2. Operate, administer, promote, and deliver events and Services.

  3. Create speaker profiles, sponsor profiles, session pages, event websites, emails, graphics, promotional materials, printed and digital event materials, surveys, reports, and operational records.

  4. Communicate with you and other authorized event participants.

  5. Provide, secure, improve, troubleshoot, and document the Services.

  6. Comply with applicable legal, contractual, audit, tax, accounting, and recordkeeping obligations.

Public or promotional use of speaker, sponsor, exhibitor, partner, Author, or other participant materials may also be governed by separate agreements, releases, approval workflows, or event specific terms.

4. Third Party Information

If you submit information about a co presenter, colleague, company representative, customer, sponsor, partner, or other third party, you are responsible for ensuring that you have appropriate permission to provide that information and that the information is accurate.

You should not submit sensitive personal information about another person unless specifically requested and appropriately permitted.

5. Applications, Selection, Participation, and Publication

Submitting an application, completing onboarding, providing materials, receiving an automated confirmation, receiving a draft profile or graphic, or communicating with WorkPossible does not guarantee selection, participation, publication, promotion, payment, reimbursement, sponsorship benefits, exhibitor benefits, ticket access, or any particular event outcome.

WorkPossible may accept, reject, waitlist, modify, reschedule, remove, or decline applications, sessions, profiles, sponsor materials, promotional materials, or participation when reasonably necessary for event operations, quality, compliance, scheduling, safety, or business purposes, subject to any applicable separate written agreement.

6. AI Assisted and Generated Materials

The Services may use automation, templates, artificial intelligence assisted tools, or service providers to generate or support drafts of speaker profiles, application or review summaries, emails, promotional graphics, attendee graphics, sponsor materials, internal notes, task comments, reports, and other materials.

Generated materials may contain errors and may require review, approval, editing, or rejection by WorkPossible, event organizers, staff, speakers, sponsors, or other authorized users.

AI assisted or generated materials do not guarantee selection, approval, publication, accuracy, or legal compliance.

You are responsible for reviewing materials presented to you for approval and promptly notifying WorkPossible if changes are needed.

7. Electronic Records, Acknowledgements, and Signatures

The Services may ask you to check a box, click a button, type your name, approve materials, upload a file, submit a form, or provide a digital signature.

You agree that these electronic actions may be used as evidence of submission, review, approval, acknowledgement, consent, acceptance, or signature for the related workflow, document, policy, or task to the extent permitted by applicable law.

Electronic records may satisfy written record requirements where permitted by applicable law. Certain workflows may require additional signature steps, identity verification, or separate written agreements.

8. Private Links and Access

Some Services are accessed through private links, access tokens, accounts, or event specific pages. You are responsible for keeping these access methods secure and should not share them with unauthorized people.

If you believe a private link, account, or credential has been misused or accessed without authorization, please notify WorkPossible promptly.

We may expire, revoke, rotate, disable, or restrict private links and access credentials for security, operational, legal, or misuse prevention purposes.

9. Third Party Services

The Services may link to or integrate with third party websites, ticketing platforms, payment processors, accounting providers, file storage providers, video or meeting platforms, email providers, social platforms, professional profile pages, analytics services, AI providers, or other tools.

Third party services are governed by their own terms, privacy policies, and security practices. WorkPossible is not responsible for third party services outside our control.

Your use of those services may require separate accounts, permissions, payments, consents, or agreements.

10. Communications

You agree that WorkPossible and authorized service providers may contact you regarding applications, onboarding, registrations, tickets, sponsor materials, invoices, event logistics, uploaded materials, approvals, comments, reminders, surveys, support requests, and other operational matters related to your interactions with us.

Operational and transactional communications may be necessary to administer an event or provide the Services.

Marketing communications, if any, will include opt out mechanisms where required by applicable law.

11. Privacy

WorkPossible is committed to protecting personal information. Our collection, use, disclosure, and retention of personal information are described in our Privacy Policy.

By using the Services, you acknowledge that personal information may be processed as described in the Privacy Policy and any applicable event specific notice.

PART II: EVENT TERMS

12. Nondiscrimination

WorkPossible prohibits discrimination, harassment, and bullying against any person based on age, ancestry, color, disability, national origin, race, religion, sex, sexual orientation, gender identity or expression, marital status, veteran status, political affiliation, or any other characteristic protected by applicable law.

13. Event Conduct and Safety

WorkPossible is committed to providing a safe, inclusive, productive, and welcoming environment for participants, staff, speakers, sponsors, exhibitors, vendors, and others attending WorkPossible events.

Discrimination, harassment, bullying, threatening behavior, or other conduct that materially interferes with the safety or participation of others is not permitted at WorkPossible events.

Participants are expected to respect the rights and safety of others and comply with applicable venue rules and instructions from authorized event personnel.

If you witness or experience behavior inconsistent with these principles, please notify onsite WorkPossible staff. Event staff may assist participants in contacting venue management, security, local law enforcement, or other appropriate resources.

Concerns may also be reported to info@workpossible.org.

WorkPossible reserves the right to take reasonable action in response to conduct or safety concerns, including warning a participant, restricting participation, or removing a participant from an event where appropriate.

14. Event Liability Waiver and Release

In consideration for being permitted to register for and participate in a WorkPossible event, you acknowledge and assume the ordinary risks associated with attending and participating in an in person or virtual event.

To the fullest extent permitted by applicable law, you waive and release WorkPossible and its members, officers, employees, board members, agents, contractors, and volunteers from liability for expense, loss, damage, personal injury, disability, property damage, property theft, or other harm you may suffer or sustain before, during, or after an event, except to the extent caused by WorkPossible’s gross negligence, willful misconduct, or where liability cannot legally be waived.

This waiver and release is intended to bind you and, to the extent permitted by applicable law, your heirs and assigns.

15. Invited Speakers

If you agree to speak at a WorkPossible event or service offering, we may use and share information reasonably necessary to promote and administer your participation, including your name, company, job title, biography, headshot, professional contact information, session information, company website, and professional or social media links.

Speakers may also be asked to complete a speaker agreement, acceptance letter, media release, copyright license, or other event specific agreement. Those agreements will control where they provide more specific terms concerning a speaker’s participation or materials.

16. Credential and Badge Scanning

Sponsors, exhibitors, event partners, and other third parties may request your personal information at their booths, presentations, or other event activities.

Providing your information to these parties is optional unless otherwise clearly disclosed as part of a particular event activity.

If you present your badge for scanning or otherwise voluntarily provide personal information to a third party, you understand that the information is being provided to an entity outside WorkPossible. That entity’s use of your information is governed by its own privacy practices, and WorkPossible is not responsible for how that third party subsequently uses your information.

17. Photography, Video, Audio, and Event Media

WorkPossible may hire professional photographers, videographers, audio providers, livestream providers, or other service providers to document and share the event experience.

WorkPossible may photograph, film, livestream, or otherwise record portions of its events and may use resulting event footage and recordings for event coverage, marketing, promotional, educational, archival, and other lawful business purposes.

By attending a WorkPossible event, you acknowledge that you may appear in event photography, video, audio, or other media captured in public or group event settings.

Attendees may use handheld cameras and smartphones to capture event experiences for personal, noncommercial use, provided doing so is not disruptive and does not violate applicable event rules or the rights of others.

Attendees, speakers, and sponsors may share their own event related content on social media provided that their activities do not infringe the intellectual property, privacy, publicity, confidentiality, or other rights of WorkPossible or another person.

You are responsible for obtaining any permissions or releases necessary for content you independently capture, publish, or distribute.

Because attendees may possess personal recording devices, WorkPossible cannot control every photograph or recording independently made by another participant and disclaims responsibility for unauthorized capture or use by third parties to the extent permitted by law.

18. Event Tickets, Transfers, Cancellations, and Refunds

Unless otherwise stated in writing for a particular event, all WorkPossible event ticket sales are final and nonrefundable.

Registrants may request to transfer a ticket to another individual or to a future WorkPossible event at no charge if the request is submitted in writing at least 21 days before the event start date.

Transfer requests submitted within 21 days of the event may not be honored.

To request a transfer, contact info@workpossible.org.

If a particular event has separate cancellation, transfer, refund, or ticketing terms disclosed during registration, those event specific terms will control.

19. Marketing and Brand Assets

If you provide WorkPossible with your company name, logo, trademarks, or other brand assets in connection with a sponsorship, partnership, speaker engagement, exhibitor relationship, or other business relationship, you grant WorkPossible permission to use those materials for purposes reasonably related to administering, identifying, marketing, and promoting that relationship.

This may include use on event websites, social media, event signage, programs, presentations, emails, and other promotional materials, without implying an endorsement beyond the applicable relationship.

If you wish to withdraw permission for future use of your Brand Assets, contact info@workpossible.org. We will make reasonable efforts to discontinue use in new materials but may be unable to remove materials already printed, published, distributed, archived, or otherwise in circulation.

PART III: LEARNING CENTER TERMS

20. Course Enrollment and Access

A “Student” is a User who enrolls in a course or obtains related educational services through the WorkPossible Learning Center.

Whether content is offered free of charge or for a fee, Learning Center content is licensed rather than sold to you.

WorkPossible grants Students a limited, nonexclusive, nontransferable license to access and view content for which all required fees have been paid solely for personal, noncommercial, educational purposes and subject to these Terms and any restrictions associated with the particular content.

Unless WorkPossible gives you express written permission, you may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works from, sublicense, or otherwise commercially exploit Learning Center content.

You may not share account information or use another method to provide unauthorized access to Learning Center content.

21. Course Access Period

Unless otherwise stated when you enroll, WorkPossible provides Students with ongoing access to purchased Learning Center content.

We reserve the right to disable or revoke access when reasonably necessary for legal, intellectual property, security, contractual, or policy reasons, including where content becomes the subject of a valid copyright complaint or violates these Terms.

22. Learning Center Payments

When you make a purchase, you agree to use a valid and authorized payment method.

You agree to pay the fees associated with content you purchase and authorize WorkPossible and its payment service providers to process the applicable payment.

If a payment fails but you receive access to purchased content, you agree to pay the outstanding amount within 30 days after receiving notice from us. WorkPossible may disable access to content for which payment has not been received.

23. Learning Center Refunds

WorkPossible offers a 14 day refund or credit period for most Learning Center content purchases.

If purchased content is not what you expected, you may request a refund within 14 days of purchase by contacting info@workpossible.org.

Depending on the purchase method and capabilities of our payment service providers, refunds may be returned to the original payment method or provided as a credit toward a future WorkPossible purchase.

Unless otherwise required by law, no refund is due if a request is submitted after the 14 day period. WorkPossible may provide refunds outside this period when content becomes unavailable for legal or policy reasons or in other circumstances at our discretion.

If we reasonably believe the refund policy is being abused, including where a substantial portion of content has been consumed before a refund is requested, we may deny the refund, restrict future refunds, or restrict access to the Learning Center, to the extent permitted by law.

PART IV: AUTHOR TERMS

24. Application of Author Terms

An “Author” is a User who provides or uploads educational content for distribution through the WorkPossible Learning Center.

These Author Terms apply in addition to the other applicable portions of these Terms.

25. Author Obligations

Authors are responsible for all courses and educational materials they provide, including lectures, quizzes, exercises, practice tests, assignments, resources, answers, course landing page content, assessments, announcements, and supplemental materials (“Course Content”).

You represent and warrant that:

  1. You will provide and maintain accurate information.

  2. You own or possess the licenses, rights, consents, permissions, and authority necessary to authorize WorkPossible to use your Course Content as contemplated by these Terms and any applicable separate agreement.

  3. Your Course Content will not infringe or misappropriate another party’s intellectual property or other rights.

  4. You possess the qualifications, credentials, knowledge, or expertise reasonably necessary to provide the instruction or services you offer.

  5. You will make reasonable efforts to provide content and services consistent with applicable professional and instructional standards.

Authors may not:

  1. Submit unlawful, infringing, defamatory, hateful, pornographic, intentionally false, malicious, or otherwise prohibited content.

  2. Use the Learning Center to distribute unauthorized advertising, spam, or solicitations.

  3. Use the Learning Center for purposes unrelated to authorized educational services.

  4. Circumvent, frame, embed, scrape, or otherwise misuse the Learning Center.

  5. Impersonate another person or gain unauthorized access to another person’s account.

  6. Interfere with another Author’s ability to provide content or services.

  7. Abuse WorkPossible systems, resources, or support services.

26. Author Revenue Share

Unless a separate written agreement states otherwise, Authors receive 60% of the Net Amount from sales of their Course Content.

The “Net Amount” means the amount actually received by WorkPossible from a Student for the applicable sale, less applicable transaction taxes, payment processing fees, refunds, chargebacks, and other checkout or transaction fees.

Any additional revenue sharing arrangements between an Author and co Authors are the responsibility of the applicable Authors unless WorkPossible expressly agrees otherwise in writing.

27. License to WorkPossible

In addition to the Submitted Content license above, Authors grant WorkPossible the rights reasonably necessary to offer, host, distribute, license, market, promote, and deliver their Course Content through the Learning Center.

This may include formatting, captioning, editing, or otherwise adapting Course Content as reasonably necessary for accessibility, technical delivery, marketing, or presentation.

WorkPossible may sublicense Course Content as necessary to provide access to Students and through authorized distributors, resellers, affiliates, promotional partners, or other distribution channels.

Authors authorize WorkPossible to use their name, professional biography, likeness, voice, and image as reasonably necessary to identify, market, promote, and deliver their Course Content and participation in the Learning Center, subject to any applicable Appearance Release and Copyright License or other written agreement.

28. Trust, Safety, and Content Standards

Authors agree to comply with WorkPossible content quality, trust, safety, and other applicable policies communicated through the Learning Center or otherwise provided to Authors.

WorkPossible may remove Course Content, suspend access, suspend payouts, or restrict an Author’s participation when reasonably necessary because of violations of these Terms or other applicable policies, intellectual property concerns, fraud, unlawful activity, material quality issues, or conduct that materially harms Students, WorkPossible, or the Learning Center.

29. Student Information

Authors may receive limited information about Students as necessary to provide Course Content or related services.

Authors may use Student information only for legitimate purposes related to providing the applicable Course or Learning Center service and may not use such information for unauthorized marketing, resale, solicitation, or unrelated purposes.

Authors should not solicit unnecessary personal information from Students or store Student personal information outside authorized systems except where necessary and permitted by WorkPossible and applicable law.

30. Anti Piracy Efforts

WorkPossible may use anti piracy vendors or other service providers to help protect Course Content from unauthorized use.

To facilitate these efforts, Authors authorize WorkPossible and its authorized anti piracy providers to act on their behalf for purposes such as copyright notice and takedown procedures and other reasonable efforts to address unauthorized distribution.

WorkPossible does not have an affirmative obligation to monitor the internet or otherwise police unauthorized use of Course Content.

An Author may revoke this authorization by emailing info@workpossible.org from the email address associated with the Author’s account with the subject line “Revoke Anti Piracy Protection Rights.” Revocation will become effective 48 hours after receipt.

31. Course Pricing

The base price for paid Course Content will be established as agreed between WorkPossible and the Author.

When a Student purchases content using a foreign currency, the applicable price may be converted using the currency conversion methods available through WorkPossible or its payment providers.

Authors authorize WorkPossible to provide Course Content without charge to WorkPossible employees, selected partners, and users whose previously purchased access must be restored. Unless otherwise agreed in writing, Authors will not receive compensation for such access.

32. Transaction Taxes

Where applicable law requires WorkPossible to collect sales, use, value added, or similar transaction taxes associated with Learning Center sales, WorkPossible may collect and remit those taxes to the appropriate governmental authorities.

33. Author Payments

WorkPossible will calculate an Author’s revenue share based on the applicable Net Amount and the revenue share described above.

Unless a separate written agreement provides otherwise, Authors receive 60% of the Net Amount.

Payments will be made in U.S. dollars.

Authors are responsible for providing accurate payment information and any tax or identification documentation reasonably required for WorkPossible to issue payments.

WorkPossible may withhold payments where required by law or when reasonably necessary because of suspected fraud, intellectual property violations, missing tax documentation, chargebacks, refunds, or other material violations of these Terms.

Unless otherwise agreed in writing, Author payments will be made within 45 days following the end of the month in which WorkPossible receives the applicable Course payment.

Authors are responsible for determining and satisfying their own tax obligations arising from payments they receive.

If WorkPossible cannot deliver funds within the period established by applicable unclaimed property laws, those funds may be handled as required by applicable law.

34. Author Refund Adjustments

Authors do not receive revenue for transactions that are refunded.

If a Student receives a refund after WorkPossible has already paid the applicable Author revenue share, WorkPossible may deduct the refunded amount attributable to the Author from future payments.

If future payments are insufficient to cover the applicable adjustment, WorkPossible may request repayment from the Author.

35. WorkPossible Trademarks

Authors may use WorkPossible trademarks only as expressly authorized and in accordance with any applicable brand guidelines.

Authors must use WorkPossible trademarks only in connection with authorized promotion of their Course Content or participation in the Learning Center and must discontinue use when requested.

Authors may not use WorkPossible trademarks in a misleading manner, imply an endorsement that has not been authorized, or use the marks in connection with unlawful content or activities.

PART V: APPEARANCE RELEASE AND COPYRIGHT LICENSE

36. Appearance and Recording Rights

Where you participate in a recording specifically created for the Learning Center, a WorkPossible event, or other WorkPossible content, the following provisions apply unless a separate written appearance release, speaker agreement, or other agreement provides different terms.

You grant WorkPossible the right to photograph, film, and record your appearance and voice in connection with the applicable event, Course, Learning Center content, or WorkPossible production (the “Recording”).

You grant WorkPossible and its affiliates, successors, licensees, agents, and assigns the right to use your name, likeness, appearance, voice, professional biographical information, and the Recording in connection with the applicable content and the advertising, marketing, promotion, distribution, and operation of WorkPossible and its Services.

Unless otherwise provided in a separate written agreement, these rights are worldwide, royalty free, and may be exercised in media or formats now known or later developed.

WorkPossible may edit, adapt, reproduce, distribute, display, publish, and otherwise use the Recording in connection with these purposes.

You represent that you have the right, power, and authority to grant these permissions.

WorkPossible is not obligated to use a Recording or Course Content or to create, produce, advertise, or promote any particular content.

To the extent permitted by applicable law and any separate written agreement, you waive claims arising solely from WorkPossible’s authorized use of the Recording pursuant to these Terms.

Where a separate Appearance Release and Copyright License, speaker agreement, media release, or other written agreement applies, that agreement controls with respect to the rights addressed by that agreement.

PART VI: GENERAL LEGAL TERMS

37. Intellectual Property

Except for Submitted Content and other materials owned by Users or third parties, the Services and WorkPossible provided materials, including software, designs, workflows, templates, graphics, page layouts, text, code, trademarks, and other materials, are owned by WorkPossible or its licensors and protected by applicable intellectual property laws.

These Terms do not grant you ownership of WorkPossible intellectual property.

You may use WorkPossible provided materials only as authorized for the applicable event, Course, or workflow. You may not copy, modify, distribute, resell, sublicense, or commercially exploit WorkPossible materials except as expressly permitted by these Terms or another written agreement.

38. Independent Views

The views expressed by Users, Authors, speakers, sponsors, exhibitors, partners, or other event participants are their own and do not necessarily represent the views of WorkPossible.

Users are responsible for their own presentations, Course Content, marketing materials, advertisements, statements, and other content.

39. Availability, Changes, and Errors

The Services are provided on an “as is” and “as available” basis.

WorkPossible may update, modify, suspend, discontinue, or restrict Services, workflows, pages, tasks, features, templates, requirements, or access methods.

We do not guarantee that the Services will always be uninterrupted, error free, secure, or available.

WorkPossible may correct errors, update records, regenerate materials, reopen or close tasks, or request additional information where reasonably necessary for event or Service operations.

40. Disclaimer of Warranties

To the fullest extent permitted by applicable law, WorkPossible disclaims warranties, express or implied, relating to the Services, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, availability, accuracy, and error free operation.

Nothing in these Terms excludes warranties, remedies, or other rights that cannot legally be excluded or limited.

41. Limitation of Liability

To the fullest extent permitted by applicable law, WorkPossible and its officers, directors, employees, contractors, service providers, licensors, agents, and volunteers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost profit damages arising from or related to the Services, Submitted Content, event workflows, generated materials, third party services, Learning Center content, or these Terms.

Nothing in these Terms limits or excludes liability to the extent such liability cannot be limited or excluded under applicable law.

The event specific waiver and release contained in these Terms applies in addition to this general limitation of liability.

42. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless WorkPossible and its officers, directors, employees, contractors, service providers, licensors, and agents from third party claims, damages, liabilities, losses, costs, and reasonable attorneys’ fees arising from or related to your Submitted Content, your unauthorized or unlawful use of the Services, your material violation of these Terms, or your infringement or violation of another person’s rights.

43. Relationship Between Us

Nothing in these Terms creates a joint venture, partnership, employment, franchise, fiduciary, or agency relationship between you and WorkPossible solely by virtue of your use of the Services.

Separate written agreements may establish additional relationships or obligations between WorkPossible and particular speakers, Authors, contractors, sponsors, partners, or other parties.

44. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, events, business practices, or legal requirements.

The “Last Updated” date at the top of these Terms indicates the latest revision.

If we make material changes, we may provide additional notice where appropriate, such as by posting a notice through the Services or sending an email.

Continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

45. Translations

If these Terms are provided in a language other than English, the translation is provided for convenience. To the extent permitted by applicable law, the English language version will control in the event of a conflict.

46. Survival

Provisions that by their nature should survive termination or expiration of these Terms will survive, including provisions relating to intellectual property, licenses, payment obligations, refunds, limitations of liability, indemnification, and other provisions necessary to accomplish their intended effect.

47. Entire Agreement

These Terms, together with the Privacy Policy and any applicable event specific terms, agreements, releases, licenses, or other written agreements incorporated by reference, constitute the agreement between you and WorkPossible regarding the subject matter they address.

Where a separate written agreement governs a specific relationship or subject matter, that agreement will control over inconsistent provisions of these general Terms for that subject matter.

48. Assignment

WorkPossible may assign these Terms and its rights and obligations under them, in whole or in part, in connection with a merger, acquisition, reorganization, sale of assets, corporate restructuring, or other lawful business transaction or as otherwise permitted by law.

49. Governing Law and Venue

These Terms and all matters arising out of or relating to them will be governed by and construed in accordance with the laws of the State of Wisconsin, without giving effect to applicable choice or conflict of law principles.

To the extent permitted by applicable law, any claim or cause of action arising under or relating to these Terms will be brought exclusively in the applicable state or federal courts located in Dane County, Wisconsin, and you consent to the jurisdiction of those courts.
